Summary: The paper focuses on selected aspects of the registration and use of trademarks in the field of food and beverages and on the specificities associated with this sector. Trademarks play a key role in building brand identity, protecting intellectual property and ensuring fair competition. In the context of registration, the focus is mainly on issues related to distinctiveness, both in terms of the basic prerequisite for registration of the sign, in terms of possible subsequent acquisition of distinctiveness and in terms of possible subsequent loss of distinctiveness. In addition to distinctiveness, attention is also focused on other absolute grounds for unregistrability, in particular deceptive registrations for alternative products. Various aspects of the use of trademarks are then examined in relation to trademark registration. The article offers insights into the relationship between legislation and marketing practice, highlighting the importance of a strategic approach to trademarks in the dynamic environment of the food market.
