Summary: The author focuses in the paper on the legal analysis of the name of the food as a mandatory particular under Article 9(1) of Regulation (EU) No. 1169/2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers and amending Regulation (EC) No. 1924/2006 and (EC) No. 1925/2006 and repealing Commission Directive 87/250/EEC, Council Directive 90/496/EEC, Commission Directive 1999/10/EC, Directive 2000/13/EC of the European Parliament and of the Council, Commission Directives 2002/67/EC and 2008/5/EC and Commission Regulation (EC) No. 608/2004 and the Institute for the mutual recognition of food names in the European Union. In particular, through the methods of synthesis and analysis, it examines the legislation in this area, also with an emphasis on the case-law of the Court of Justice of the European Union. The paper begins by describing the horizontal legal framework for food labelling in the European Union. In the first chapter, the author analyses the name of the food as a mandatory indication under Article 9(1) of Regulation (EU) No. 1169/2011 of the European Parliament and of the Council. In the second chapter, the author discusses practical examples from food and judicial practice of mutual recognition of food names. The third chapter summarises and generalises the institution of mutual recognition of food names in the European Union. The aim of the paper is to provide the reader with a comprehensive summary of the legal regulation and food practice of mutual recognition of food names in the European Union and also to offer solutions to the problematic and contentious issues concerning the cross-border labelling of foods by their names.
