Summary: The aim of this paper is to analyse the judgment of the Court of Justice of the European Union in Case C-438/23, Protéines France, concerning the labelling of plant-based foods, specifically alternatives to the meat and meat products sector. The introduction introduces the reader to the context of the issue and presents the relevance of the issue under examination for legal and food practice. In the second chapter, the author discusses the facts of the judgment, focusing in particular on the decree and its disputed provisions. In the third chapter, the author discusses the issues of harmonisation of European Union law and their impact on the decree and its compatibility or otherwise with European Union law. In the remainder of the paper, the author discusses the interpretation of the Court of Justice of the European Union in relation to the legal name of foodstuffs, the customary name and the descriptive name. In the conclusion of the paper, the author summarises the interpretation of the Court of Justice and its relevance for legal and food practice.
