Summary: Number of fake products offered and sold at internet increases every year. The paper analyses an online purchase of a fake product by a consumer, the respective consumer’s rights and legal steps to be taken against a seller of a fake product under Czech law. Generally, fakes can be offered and sold at internet as a business or as a private deal. Sale of a fake at internet under a business activity legally entitles a consumer to withdraw from a purchase agreement within 14 days from a delivery of the purchased fake product to the consumer as a buyer. Alternatively, the consumer can claim a defective quality of the purchased product. On the other hand, such a legal procedure does not apply if a fake product is sold online privately by a natural person. Except a purchase of fake cigarettes a consumer is not liable for an online purchase of any other fake product under Czech law.
